RELEASE AND WAIVER OF LIABILITY

I acknowledge and agree that this agreement (the “Agreement”) covers and is intended to release and provide other benefits, legal protections, and consideration to Toucan Play LLC, and their respective and collective agents, owners, officers, managers, shareholders, affiliates, volunteers, participants, employees, and all other persons or entities acting in any capacity on their respective or collective behalf. I acknowledge and agree that I am hereby agreeing to release and fully discharge PC from causes of action of any nature and kind, known or unknown, which I may have against Toucan Play arising out of or relating to any injury, loss or damage of any kind to any person or property that may be sustain as a result of participating in the Activity.

COVID-19 & OTHER VIRUSES RELEASE I understand that the World Health Organization has classified the COVID-19 outbreak as a pandemic. I further understand that COVID-19 is a highly contagious and dangerous disease, and that contact with the virus that causes COVID-19 may result in significant personal injury or death. I am aware that entering the facility and/or participating (and/or having my Child participate) in the Activity may carry certain inherent risks related to COVID-19 transmission, as well as other viruses (ex. Norovirus) that cannot be eliminated regardless of the care taken to avoid such risks.

LIABILITY RELEASE I hereby forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue Toucan Play LLC, and their successors, predecessors-in-interest, managers, agents, representatives, employees, successors, and insurers (collectively, the “Releasees") from any and all claims, demands, rights, actions, lawsuits, causes of action, obligations, debts, costs, losses, charges, expenses, attorneys’ fees, damages, judgments and liabilities, including attorney’s fees, of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether or not concealed or hidden, related to or arising, directly or indirectly, from my or the Child’s access to and/or use of the premises and/or its equipment (whether inflatables or otherwise), the Child’s and/or my entry into the facility, the condition, maintenance, inspection, supervision, control or security of the facility, the failure to warn of dangerous conditions in connection with Toucan Play, and/or the acts or omissions of or any of the Releases, including, without limitation, any claim for negligence, failure to warn or other omission, property damage, personal injury, emotional injury, illness, bodily harm, paralysis or death.

By signing below, I represent and warrant that I am the parent, legal guardian, or power-of-attorney of the above listed Child(ren) and have the authority to execute this Agreement on his/her or their behalf and to act on his/her or their behalf. I have read each and every paragraph in this document and I and they agree to be bound by the terms stated therein, including the release of liability contained therein.
